Kathy Hochul has imposed a one-year New York data center moratorium covering new projects with power demand of 50 megawatts or more, temporarily stopping state environmental permits while regulators examine energy, water, noise and community impacts. The executive action, signed July 14, applies statewide and places the first broad state-level pause on hyperscale development in the United States. It arrives as developers, utilities, mechanical contractors and cooling-equipment suppliers pursue a fast-growing pipeline of artificial-intelligence infrastructure across the Northeast.

The order suspends issuance of state environmental permits for qualifying projects during the review period. Projects below the 50-MW threshold are not covered by the statewide pause, and the order does not itself cancel facilities that already possess the required approvals. The administration said the review will be used to develop standards for future development rather than establish a permanent prohibition.
Large data centers can require chilled-water plants, air-cooled chillers, cooling towers, computer-room air handlers, direct-to-chip liquid-cooling loops and extensive backup-power systems. The 50-MW threshold is based on facility energy demand, not cooling capacity, but projects at that scale generally carry substantial mechanical and electrical packages. State permitting decisions can therefore determine the timing of equipment orders, engineering work, construction mobilization and commissioning.
The executive order also links future approvals to labor and community requirements. The administration highlighted local hiring, union apprenticeship participation and prevailing-wage standards as elements of the policy framework. Those provisions place workforce rules alongside power, water and environmental review in the state’s approach to large computing facilities.
New York’s action follows months of debate over the electricity requirements of artificial-intelligence infrastructure. Utilities and grid planners have been evaluating how quickly new generation and transmission can be added while maintaining reliability. Local officials have separately examined water use, generator emissions, land use and continuous equipment noise from cooling and power systems.
New York Data Center Moratorium Follows Project Backlash
The immediate policy backdrop includes opposition to a proposed multibillion-dollar data center in Genesee County and similar disputes elsewhere in the state. Public concerns have centered on electricity rates, the use of tax incentives, water demand and the scale of industrial development near residential communities. Developers have argued that the projects bring construction employment, permanent technical jobs and a larger tax base.
New York is not the first jurisdiction to consider a pause, but the statewide executive order is broader than local moratoriums adopted or debated in individual municipalities. Legislatures in several states have introduced proposals addressing data center incentives, energy costs and siting. Maine lawmakers approved a moratorium earlier in 2026, but that measure was vetoed. Local restrictions have also appeared in communities in Wisconsin, Virginia and other fast-growing data center markets.
The order comes as the New York Legislature has passed the Responsible Data Center Development Act. Hochul had not signed that bill when the executive order was announced. The legislative measure and the executive review address overlapping questions about utility planning, environmental impacts and conditions attached to major projects, but they proceed through separate legal mechanisms.
The policy debate is occurring during a national expansion of data center construction. Federal construction figures show spending on the category rising while several other private nonresidential segments have slowed. The concentration of demand has tightened availability for electrical gear, generators and specialized cooling equipment and has drawn mechanical and electrical contractors toward large campus projects.
What Comes Next Under the New York Data Center Moratorium
State agencies are expected to use the one-year period to evaluate permitting standards and recommend conditions for future projects. The order does not provide a final technical standard for cooling water, power sourcing or heat rejection. Those details will be developed through the review, leaving the eventual requirements for mechanical systems and site infrastructure unresolved.
Projects already in development will have to determine whether they fall within the order’s scope and whether outstanding permits are affected. The answer will depend on project size, permit status and the specific state approvals still required. Local land-use approvals remain a separate layer of review, and utilities will continue to assess interconnection and service requirements.
The New York data center moratorium is scheduled to last one year unless the administration changes or extends it. During that period, the state will continue receiving proposals for smaller facilities and reviewing projects that are outside the covered permitting stage. The resulting standards will shape when the largest campuses can resume moving through the state approval process.
