EPA has proposed changing the federal rules governing public participation for certain minor New Source Review air permits. Under the proposal, state and local agencies would gain more discretion over whether and how the public is involved.
Why Data Centers Are Part of the Debate
Large data centers can contain significant fleets of diesel generators or other on-site power equipment.
Depending on the facility and permitting structure, some projects can fall under minor-source or synthetic-minor permitting rather than the rules covering major pollution sources.
Environmental groups say removing the federal public-notice requirement could make it easier for some projects to advance with less public scrutiny.
EPA argues the change would reduce administrative burdens and allow local regulators to decide what level of public participation is appropriate.
Why HVAC Should Care
Air permits are not mechanical permits.
But they can still affect the project schedule.
A hyperscale facility may have hundreds of millions of dollars of cooling infrastructure planned.
If another part of the site cannot obtain regulatory approval, the HVAC package does not move ahead either.
That means mechanical contractors increasingly need to pay attention to:

- Environmental challenges
- Water constraints
These issues can determine whether enormous cooling projects actually reach construction.
Opposition Is Growing
Fourteen states and three cities have formally opposed the proposed change, according to recent reporting.

Communities want more input into facilities that can consume enormous amounts of power and water.
Cooling Demand Does Not Guarantee Construction
The HVAC industry is rightly excited about the data-center market.
