One of America's most aggressive appliance rules is being softened before it even takes effect.
But industry groups say the proposed changes still do not go far enough.
The Bay Area Air District adopted a first-of-its-kind rule requiring many residential water heaters rated at 75,000 Btu/h or less to meet zero-NOx requirements beginning in 2027.
After concerns around affordability and installation practicality, regulators have proposed delaying that deadline until January 1, 2028.
Emergency Replacements Are the Problem
Anyone who works in home services knows how water heaters are typically replaced.
Not because the homeowner planned an electrification project six months earlier.
Because the tank failed.
The house has no hot water.
And someone needs to fix it.
The proposed amendments would create an emergency exception allowing temporary installation of a noncompliant unit, but it would then have to be replaced with compliant equipment within 12 months.

Contractors See Practical Barriers
Heat-pump water heaters can require more than simply changing the tank.
Some homes may need:
- Electrical-panel work
- New circuits
- Different installation space
- Condensate drainage
- Airflow considerations
Regulators are considering exemptions for some low-income customers and installations where electrical or space constraints make compliance particularly difficult.
